LSK Defends Lawyer Ahmednasir, Files Petition to Annul Supreme Court Ban

In an effort to overturn the Supreme Court’s ruling that barred senior counsel Ahmednasir Abdullahi and his legal business from appearing before it, the Law Society of Kenya has come out in support of the senior attorney.

LSK files petition to defend Ahmednasir and Quash Supreme Court’s ban

Through attorney Gitau Singh, LSK filed a case before the Milimani Law Courts on Thursday, January 25, 2024, claiming that the Apex court’s ruling was irrational and unfair.

Despite the “serious nature of the allegations and veracity of the decision,” he claims the court condemned the senior lawyer, his staff, and anybody else carrying a brief for him without giving them a chance to be heard.

In a letter signed by Registrar L.M. Wachira, the Supreme Court announced last week that it had decided to bar the senior attorney.

In the letter, the court stated that the attorney and his legal team should not come before it due to years of continuously offensive comments posted on social media about the organization and its judges.

The Statement read in part by a KEnews254 reporter stated;

“In view of the foregoing, it is the decision of this Court, that henceforth and from the date of this communication, you shall have no audience before the Court, either by yourself, through an employee of your law firm, or any other person holding brief for you,” the statement read in part.

The statement further asserted that individuals who may have given the attorney instructions to defend themselves in court would undoubtedly be impacted by this ruling. It was intolerable that he would pursue justice within the very institution and before the very judges, whose integrity and reputation the lawyer is constantly undermining.

In its legal filings, LSK charges that the Supreme Court disseminated the information without providing evidence for how the ruling was made or naming the justices who agreed or disagreed with it.

It has referred to the ruling as unjust, claiming that the Supreme Court withheld its reasoning from public view.

“The Supreme Court has not shown that it has carried out any independent investigations to discredit the allegations contained in the purported counsel’s publications.”

It continues by saying that not only does the decision prejudice his clients, but also against those who are employed by the senior counsel law firm now and in the future.

The Supreme Court and the Supreme Court registrar are named as respondents in the petition by LSK in its filings.

In addition, The Supreme Court judges were also not left out and instead, they feature on the list of those who are interested.
