Chief Justice Martha Koome has retaliated against assertions made by President William Ruto and his supporters, claiming that certain judges have been acting without consequence.

The President of the Supreme Court of Kenya urged all Kenyans to report any act that jeopardizes the integrity of the legal system and to give the JSC permission to look into it in a strongly worded statement released on Wednesday.

She expressed concern about the public criticism directed at judges and judicial officers for making court rulings that were thought to go against state plans and programs.

Koome cautioned that the judiciary was a separate and equal branch of the government. In addition, she asked all judges and other judicial officers to carry out their duty as judges without fear or favor.

“By giving citizens efficient channels for settling conflicts both within themselves and between them and the State, the Constitution imposes positive duties on the State to guarantee respect for the law and adherence to it, as the Commission seeks to bring to the attention of State and Public Officers.

“Where a citizen obtains a court order against the State and that court order is deliberately ignored or disobeyed by State officials, the right of access to justice is undermined because it fatally attacks the effectiveness of the legal system on which ordinary citizens rely to have their rights and legal duties enforced,” Koome said.

She further guaranteed that any judge or magistrate exhibiting dubious behavior would be swiftly examined by the Judiciary Service Commission (JSC), which maintained discipline in the judiciary.

“The JSC assures all Kenyans that any allegations or complaints of misconduct or corruption by any judge or judicial officer will be dealt with firmly and swiftly per the Constitution,” the statement stated.

“The Judicial Standards Commission (JSC) has a track record of disciplining judges who violate the Judicial Code of Conduct and Ethics or participate in unethical behavior. As a result, the JSC invites anyone with knowledge of any activity that jeopardizes the fairness of legal proceedings and verdicts to bring such matters to the attention of the JSC for prompt resolution.”

During a speech aimed at the judiciary on Tuesday in Nyandarua, President Ruto claimed that corrupt judges and corruption’s beneficiaries were working together to prevent Kenyans from developing.
